i.) By entering any competition, lottery or event, via the Barrow Blind Society`s website, Entrants are considered to have thoroughly read and accepted these TERMS AND CONDITIONS and agree to be bound by them;
ii.) ENTRANTS are solely and wholly responsible for providing Barrow & Districts Society for the Blind with their current and accurate contact details. Barrow & Districts Society for the Blind will be in no way liable for any failure or inability to make contact with any ENTRANT due to any omissions, errors and inaccuracies in the contact details provided by the Entrants or otherwise. Barrow & Districts Society for the Blind reserve the right to disqualify any entrant (entirely at their own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these TERMS AND CONDITIONS.
iii.) Privacy – The Entrants and the Promoters recognise that Barrow & Districts Society for the Blind may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the ENTRANTS to the Promoters to administer the Website and conduct the Competition or Event according to these TERMS AND CONDITIONS. The ENTRANTS and the Promoters also recognise that the PROMOTERS may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
iv.) The Competitions and Lotteries are open for entry to all persons aged 18 or over excluding the Promoters, their immediate family, agents, employees, professional advisers or conductor administration of the Competition in any way, shape or form.
v.) Barrow & Districts Society for the Blind Competitions are governed by English Law and any legal issues or disputes regarding the competitions or the businesses administration will be determined by the Courts of England and English Law shall have exclusive jurisdiction.
vi.) In participating in a competition, lottery or event, online via the Barrow & Districts Society for the Blind Website and in accepting these TERMS AND CONDITIONS you confirm you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. Barrow & Districts Society for the Blind Competitions will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in doubt you should immediately leave the Website and check with the relevant authorities in your country.
vii.) In entering a competition, lottery or event, ENTRANTS acknowledge that they are not guaranteed in any way that they will win a prize as the result of purchasing entry into the competition, lottery or event draw.
viii.) Barrow & Districts Society for the Blind do not in any way guarantee the value of the Prize.
ix.) The maximum number of entries that can be made by any one ENTRANT per competition is limited to 10 per competition unless stated otherwise.
x.) All competitions, Lotteries or events, run by Barrow & Districts Society for the Blind are only playable by residents of the United Kingdom. Players from outside this area are not eligible to play and any entries from outside of the United Kingdom are null and void.
xi.) All Entries will become the property of Barrow & Districts Society for the Blind Competitions and Lotteries on receipt and will not be returned.
xii.) Barrow & Districts Society for the Blind competitions, lotteries and events, reserve the right to amend these TERMS AND CONDITIONS for any reason and at any time.
xiii.) To complete an entry into a competition, lottery or event Entrants will be asked to provide their contact details – including postal and e-mail addresses and a telephone number – and card payment details for entry fee only. Once the Entry is submitted, the Entrant’s card payment will be electronically approved.
xiv.) If you would like to enter the competition for free then please send a blank postcard in the post to the below address stating; The competition you wish to enter, your answer to the competition question, your full name, address, telephone number and email address. The address to send this to is: BARROW BLIND SOCIETY, Vision Support Centre, 67/69 Cavendish Street, Barrow in Furness, Cumbria, LA14 1QD
xv.) All details must be clearly legible. We cannot enter you into the competition if we cannot read the writing on your entry, as we will be unable to enter all of your details correctly into our system. If we receive 1 letter in the post containing multiple entries this will not comply with our TERMS AND CONDITIONS and all entries will be deemed null and void. Postal entries are limited to one person per household. Furthermore, if it comes to our attention that more than 1 person per household is entering into a competition all entries from that address will be void.
xvi.) When the maximum number of entries are sold or the Closing Date is reached (whichever occurs first), the Competition or Lottery will close.
xvii.) All Entries to the competition are final. No refunds shall be issued at any time or for any reason. The only exception to this is if entries are submitted following a competition or lottery closing date.
xviii.) PayPal – You agree that upon purchasing entry to our competition, that you clearly understand and agree to what you are purchasing and will not file a fraudulent dispute via PayPal. Upon a fraudulent attempt to file a dispute, we receive the right, if necessary, to terminate your account and/or permanently ban your IP address from our website.
xix.) Barrow & Districts Society for the Blind decision is final. No communication will be entered into regarding the result of a competition following the winner being determined as described in these TERMS AND CONDITIONS.
xx.) Entrants agree that the normal requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to any competitions and draws conducted by Barrow & Districts Society for the Blind.
xxi.) If the WINNER cannot be contacted by Barrow & Districts Society for the Blind within 30 days of being informed of their win by telephone, email and postal mail to the contact details submitted during their entry, then Barrow & Districts Society for the Blind will be entitled to run the draw again and an alternative winner chosen. The alternative winner will have 14 days from being notified of their win to accept their prize.
xxii.) Winners will be required to show proof of identification on delivery of the prize. Any failure to meet this obligation may result in the WINNER being disqualified and the Promoter retaining the prize.
xxiii.) Acceptance of the prize by the WINNER will mean they are required to provide their photo and a video for Barrow & Districts Society for the Blind Competitions for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with, unless prohibited by law.
xxiv.) By entering a Competition, Lottery or Event you agree to the use of your name, address, and/or photograph or other likeness, as required by Barrow & Districts Society for the Blind if you are declared a WINNER.
xxv.) The Promoters reserve the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoters will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person; The Promoters make no representation or warranty as to the Valuation or the Prize, or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the Prize before entering the Competition.
xxvi.) Barrow & Districts Society for the Blind will not be liable for any loss – including economic loss – suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize; Barrow & Districts Society for the Blind accept no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the WINNER) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.
xxvii.) Barrow & Districts Society for the Blind will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.
xxviii.) Barrow & Districts Society for the Blind do not accept responsibility for any entries which they do not receive due to failures and errors in computer systems, other malfunctions, high internet traffic, hardware failure, software failure, server faults or any other reason.
xxix.) These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and Barrow & Districts Society for the Blind.
xxx.) An entry shall be declared void (without any refund being given) if the entrant engages in: (1) any form of fraud (actual or apparent); (2) fraudulent misrepresentation; (3) fraudulent concealment; (4) hacking or interference with the proper functioning of the website; or (5) amending, or unauthorised use of, any of the code that constitutes the Website.
xxxi.) The winning Entrant will be selected at random using Google’s Random Number Generator and will be streamed live on Facebook. Full details will be confirmed once the draw has been completed via Facebook and Instagram.
xxxii.) If the all the numbers have not been sold by the time the competition timer runs out then extra time will be added on to the competition. This will happen up to a maximum of 5 times. If all the numbers are still not sold following this then a cash alternative will be awarded to the value of 65% of the money taken during this competition. Only the competition entrants will be entered into this draw.
xxxiii.) A winner will be drawn on the Friday following the maximum number of tickets selling or the competition closing.
xxxiv.) There will only be one winner per competition unless otherwise stated.
xxxv.) Prizes are subject to change at the promoter’s discretion. If the same competition as advertised is not available once the competition has been drawn then a prize of equal value or better will be offered to the winner. Additionally, if the winner cannot accept the prize as a result of the dates offered then a prize of equal value or better will be offered to the winner. If the winner refuses the alternative prize then they will be refunded their competition entry fee and the competition redrawn.
xxxvi.) If the contest is completed and the prize is issued successfully then the prize will be transferred by the promoter to the winner through either the use of a third-party travel operator or through the promoter providing the winner with all the booking details.
xxxvii.) This Agreement shall be governed, construed, and enforced in accordance with the laws of the United Kingdom, without regard to its conflict of laws rules.
xxxviii.) All competition winners will be responsible for their own holiday and travel insurance for any of the prizes awarded. In the instance of illness, injury or death arising from any travel competition awarded by Barrow & Districts Society for the Blind, will not be liable in anyway whatsoever.
xxxix.) Barrow & Districts Society for the Blind can amend any of the TERMS AND CONDITIONS within this Agreement at our sole discretion and at any time.
Each entrant should retain a copy of these Terms and Conditions for their future reference.
ENTRANT: Anyone who enters the competition by post or through the website to win the Prize – not including a partnership, limited liability partnership or limited company.
WINNER: The ENTRANT chosen by Google’s Random Number Generator during the live draw for the specified competition. This is the person who will receive the prize in accordance with these TERMS AND CONDITIONS.
CLOSING DATE: The closing date for each competition will be shown on the specific competitions page. If, however the maximum number of entries are sold before the closing date shown then the competition will be closed in advance.
MAXIMUM NUMBER OF ENTRIES: The maximum number of entries is unique to each competition and will be specified on each competition page.
